Ministry of Labor creates Electronic Labor Domicile and digital Labor Inspection Book

On December 22, 2023, the Ministry of Labor and Employment (MTE) published Ordinance No. 3.869 that creates the Electronic Labor Domicile (DET) of companies and put in place the Electronic Labor Inspection Book (eLIT).

The purpose of the DET is the official communication and the provision of digital services between the Labor Inspection and the company, and it is made available by the Ministry of Labor and Employment through digital access.

The eLIT will be adopted electronically as one of the DET’s features, and it replaces the inspection book in a printed form.

The DET will be mandatory for all companies, even if they do not have employees, and the main purposes thereof shall be:

  • Making the company aware of any administrative acts, tax procedures, subpoenas, notifications, decisions rendered in administrative disputes and notices in general;
  • Enabling the company to send electronic documents for inspection purposes, including administrative defenses;
  • Setting up deadlines within which requirements in connection with administrative procedures or inspection measures shall be met;
  • Enabling the issuance of certificates related to administrative labor infractions, Unemployment Compensation Fund (FGTS) debts and compliance with labor obligations.

Logging on to the gov.br account shall be required to access to the DET, and the company may grant powers to another person to access the system by an Electronic Power of Attorney which is registered in the system.

The company, among other duties described in the Ordinance, shall:

  • Maintain the access to its Internet provider and the settings of the computer used for electronic transmissions;
  • Check the DET to see the communications contained in its Mailbox, which may affect deadline counting;
  • Check out the regular transmission in order to ensure effective receipt of documents by the system;
  • Provide and keep at least one email updated so as to enable the automatic sending of messages and alerts.

In times of access to information in the Digital Era, it is observed that the tools implemented by the Ministry of Labor and Employment are aimed to reduce bureaucratic procedures, making life easier for all those involved.
