Artificial intelligence is increasingly gaining space in our daily lives, being implemented in a range of areas in everyday life. Currently, its application is not limited to the replacement of ordinary tasks. For this reason, the fear of this technological tool overriding job positions is common thread in all discussions surrounding the issue.

In the legal field, the situation is not different. Several organizational tasks can already be performed by automated cognitive tools, such as (i) transcription of hearings, (ii) translations, (iii) contracts analysis and reading, and (iv) case screening, whether judicial or arbitral.

In addition, intelligent bots are already employed as prediction, strategy, and insight tools, capable of performing in-depth analysis of judicial data to enrich the decision-making process, as well as adding efficiency to proceedings.

It is undeniable that performing tasks through technology releases professionals from performing repetitive activities, increases the accuracy and speed with which they are completed, and allows lawyers and arbitrators to focus on more strategic/technical aspects of their practice. However, currently there is discussion regarding the extent to which the activities of legal-cognitive judgement – inherent in the activities of judges, arbitrators, and lawyers – can also be replaced by artificial intelligence. The question that remains is: will we live at a time when disputes will be settled by artificial intelligence?

While we may not have an answer to such a question, it is important to consider that these tools must be consciously and ethically operated, through the adoption of end-to-end encryption and advanced authentication protocols, for instance. After all, the unregulated use of these tools is a sensitive issue surrounded by numerous controversies. A case in point is the new types of litigation emerging over the improper transfer and storage of personal data, involving globally renowned technology companies.

Although the benefits brought by artificial intelligence are unquestionable, due to its organizational and information storage capacity, such tools must be used with consideration to the risks they entail, while ensuring the integrity of the data that feeds such technological tools, otherwise the potential hazards may outweigh the conveniences and functionalities provided by their use.
