Brazilian INPI approves changes to simplify the recording of Licensing Agreements

On 30 December 2022, the National Industrial Property Institute – INPI published the Minutes of the Board Meeting of 28 December 2022 which discussed a set of proposed modifications to certain proceedings related to licensing agreements in Brazil. Although the final text provisions for the new guidance depends on a resolution to be enacted by the Institute, thus not in force yet, the upcoming regulation will include provisions designed to facilitate the registration of license agreements with INPI, royalty limits and royalty payments in IP-related contracts. Such policy initiative is also potentially relevant for a review of IP licensing agreements currently registered with the INPI.
