Law 14.382/2022 and the marriage procedures improvements

The Law n. 14,382/2022, which substantially changed several articles of Law n. 6,015/1973 (that rules the public registry system), brought improvements to marriage procedures, including simplifying the change of family names, the certification procedure, and the possibility of marriage by videoconference.

Among the changes, it is now possible to request the change of family names directly at the notary’s office, for the incorporation of family last names, including or excluding partner’s last name during marriage, and excluding the spouse’s last name after divorce, regardless of judicial authorization and the involvement of the Public Prosecutor’s Office, simply by presenting the certificates and supporting documents.

In addition, the marriage qualification procedure was simplified, by dispensing the requirement for the presence of the Public Prosecutor’s Office and the previously mandatory publication of proclaim notices.

The new procedure established in the law establishes that the registry officer will electronically publicize the request, issuing within 5 days the certificate that will authorize the couple to get married at the registry office of their preference.

Another important development is the possibility of getting married remotely, by videoconference system.

The text brings welcome improvements, aiming to simplify procedures and bring agility and flexibility to public records in the case of new marriages.
