On 12 May 2025, the Brazilian National Industrial Property Institute – INPI – published the Ordinance No. 10/2025 was published, introducing significant amendments to the fee schedule for services provided by the Brazilian Patent and Trademark Office (INPI), as well as establishing new services that directly impact trademark, patent, industrial design, software, and technology contract procedures.
These changes will be implemented progressively from 7 August 2025, with notable updates regarding priority processing for trademarks and key adjustments to official fees for filings, examinations, appeals, and annuities.
The Intellectual Property team at L.O. Baptista highlights the following key updates:
A full exemption from fees has been granted to individuals in situations of proven financial hardship and persons with disabilities registered in CadÚnico or the National PwD Registry. Furthermore, INPI has announced the automation of the issuance process for the First Decade of Trademark Validity (current codes 372, 373, and 3012) and the Grant of Patent Letters (codes 212 and 213), with the aim of reducing red tape, avoiding loss of rights due to missed payments, and expediting the registration and maintenance of patents and trademarks.
For further reference, the updated fee and service schedule, along with the respective effective dates, is now available on the official INPI website.
